H–1B Worksite Visits

USCIS’ Fraud Detection and National Security Division (FDNS) is conducting a large number of worksite visits in H–1B cases. These random, unannounced worksite visits are designed to confirm compliance regarding H–1B employees working at the site.

Reports from those who have been visited by FDNS indicate that the investigator often asks for the manager/supervisor of the worksite and the H–1B worker(s). The FDNS investigators may also take pictures of the worksite including the inside and outside of the premises.

Both H–1B employers and employees should be prepared to answer any questions asked by the investigator, as well as be able to provide any requested documents. Therefore, it is essential that both employer and employee review their H–1B documentation carefully.
