Can I Cancel/Withdraw the Affidavit of Support I Filed?

This question is frequently asked regarding the I-864 Affidavit of Support.

Unfortunately, the person who filed the I-864 cannot cancel or withdraw it.

The I-864 remains effective until one of the following events take place:

  • The person for whom the I-864 was filed has accumulated 40 qualifying quarters of work in the United States.
  • The person for whom the I-864 was filed becomes a US citizen.
  • The person for whom the I-864 was filed returns abroad and no longer is a Legal Permanent Resident.
  • The person for whom the I-864 was filed dies.
  • The person who filed the I-864 dies.

                                                                                                                                                                                               

H-1Bs Filing Period Begins

The H-1B visa filing period for the 2013 Federal fiscal year, which began on October 1, 2012, has begun.

Filing appear to be being received at about twice the level of those received last year. Last year, the H-1B visas were all used by November 22, 2011. That means that, if filings continue at their present pace, H-1B visas will run out before October 1st, and may run out as early as August, 2012.

Employers wishing to file H-1B visas petitions for the 2013 Federal fiscal year need to file their petitions immediately in order to maximize the chances that a visa will be available for their employees.
